✅1. Acceptance of Terms

By accessing or using DailyMan ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and DailyMan Pty Ltd ("DailyMan", "we", "us", or "our"). These Terms apply to all users of the Service.

We reserve the right to update these Terms at any time. We will notify you of significant changes via email or an in-app notice. Your continued use of the Service after changes take effect constitutes acceptance.

DailyMan provides a private digital journaling platform that allows registered users to write, store, and manage personal diary entries ("the Service"). We offer both a free plan and premium paid plans.

We reserve the right to:

  • Modify, update, or discontinue any aspect of the Service at any time
  • Introduce new features or remove existing ones
  • Temporarily suspend the Service for maintenance, security, or improvements
  • Set limits on storage, usage, or features based on your plan type

We will provide reasonable advance notice for significant changes or planned downtime where possible.

👤3. Your Account

Registration

To use DailyMan, you must register for an account using a valid email address. You agree to provide accurate, current, and complete information during registration and to keep this information updated.

Account Security

  • You are responsible for maintaining the confidentiality of your login credentials
  • You must not share your account with others or allow others to access it
  • You are responsible for all activity that occurs under your account
  • Notify us immediately at support@dailyman.au if you suspect unauthorized access

Eligibility

You must be at least 13 years old to use DailyMan. Users between 13 and 18 require parental consent. By using the Service, you confirm that you meet these requirements.

DailyMan is built to be your private space. Here is how we treat your content:

Ownership

You retain full ownership of all journal entries, notes, and any other content you create within DailyMan ("Your Content"). We do not claim any rights over what you write.

License to Us

By using the Service, you grant DailyMan a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely for the purpose of providing and improving the Service. This license does not allow us to sell, publish, or share Your Content.

Your Responsibilities

  • You are solely responsible for the content you create in DailyMan
  • You confirm that Your Content does not violate any applicable laws or third-party rights
  • You will not upload malicious files, spam, or harmful code

🔒 We never read your journal entries. They are stored encrypted and accessed only by you. No human at DailyMan has access to your personal writings.

🚫5. Acceptable Use

When using DailyMan, you agree not to:

  • Violate any applicable local, national, or international law or regulation
  • Attempt to gain unauthorized access to any part of the Service or other accounts
  • Use the Service to transmit spam, malware, or any harmful content
  • Reverse engineer, decompile, or attempt to extract the source code of DailyMan
  • Impersonate any person or entity, or misrepresent your identity
  • Use automated bots, scrapers, or crawlers to access the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to harass, abuse, or harm any person

⚠️ Violation of these rules may result in immediate suspension or permanent termination of your account without notice or refund.

💳6. Payments & Subscriptions

Free Plan

DailyMan offers a free plan with core journaling features. No payment is required for the free plan.

Premium Plans

  • Premium plans are billed monthly or annually as selected at purchase
  • All prices are listed in the currency of your region and are inclusive of applicable taxes
  • Subscriptions auto-renew unless cancelled before the renewal date
  • You can cancel your subscription at any time from your account settings
  • Cancellation takes effect at the end of the current billing period; access continues until then

Refunds

We offer a 7-day money-back guarantee for new premium subscriptions. After 7 days, payments are non-refundable except where required by applicable consumer protection laws.

DailyMan and all of its original content, features, design, code, logos, and functionality are owned by DailyMan Pty Ltd and are protected by intellectual property laws.

  • You may not copy, reproduce, or distribute any part of the Service without our written consent
  • The DailyMan name, logo, and branding are trademarks of DailyMan Pty Ltd
  • Nothing in these Terms gives you a right to use our trademarks or branding

🔚8. Termination

By You

You may close your account at any time from your account settings. Upon deletion, your account and all associated journal entries will be permanently deleted within 30 days.

By Us

We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms. We will attempt to notify you before termination except in serious cases.

🗑️ Data Deletion: Upon account termination, all your journal entries and personal data will be permanently deleted. This action is irreversible. We recommend exporting your data before closing your account.

⚠️9. Disclaimers

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties that any defects will be corrected
  • Warranties regarding the accuracy or completeness of any content

DailyMan is a journaling tool and is not a substitute for professional mental health support. If you are experiencing a crisis, please seek professional help.

⚖️10. Limitation of Liability

To the fullest extent permitted by applicable law, DailyMan shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, goodwill, or business interruption
  • Unauthorized access to or alteration of your data
  • Any third-party conduct or content

Our total liability to you for any claims arising out of or related to these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the claim, or $50 AUD, whichever is greater.

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia. If you are located in the European Union, you may also have rights under EU consumer protection laws.
